对提前退休的审批审核也是具体行政行为

<SPAN style="FONT-SIZE: 9pt; COLOR: black"><FONT face=宋体>重庆合纵律师事务所受当事人林更屏、刘国英、吴兴惠、刘忠秀委托,并指派韩龙涛、彭杰做为其与大渡口区劳动和社会保障局和重庆市社会保险局大渡口区分局行政纠纷一案的一审代理人。开庭前我认真调查收集并审查了有关证据,查阅了有关法律、法规、规章、司法解释、及其它规范性文件,现根据《行政诉讼法》、《律师法》的规定依法出庭,提出如下代理意见,恳请法庭采纳:<SPAN lang=EN-US><?xml:namespace prefix = o ns = "urn:schemas-microsoft-com:office:office" /><o:p></o:p></SPAN></FONT></SPAN>

<SPAN style="COLOR: black; FONT-FAMILY: 宋体; FONT-VARIANT: small-caps; mso-ascii-font-family: _GB2312; mso-hansi-font-family: _GB2312"><FONT size=3>一、</FONT></SPAN><SPAN lang=EN-US style="FONT-SIZE: 7pt; COLOR: black; FONT-FAMILY: _GB2312">&nbsp;&nbsp; </SPAN><FONT size=3><SPAN style="COLOR: black; FONT-FAMILY: 宋体; FONT-VARIANT: small-caps; mso-ascii-font-family: _GB2312; mso-hansi-font-family: _GB2312">关于诉讼时效问题。</SPAN><SPAN lang=EN-US style="FONT-SIZE: 12pt; COLOR: black"><?xml:namespace prefix = o ns = "urn:schemas-microsoft-com:office:office" /><o:p></o:p></SPAN></FONT>

<FONT size=3><SPAN lang=EN-US style="COLOR: black">1</SPAN><SPAN style="COLOR: #424242; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'; mso-bidi-font-size: 15.0pt">、</SPAN><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">任何诉讼程序都包含各种各样的时效制度,行政诉讼也是如此</SPAN><SPAN style="COLOR: #424242; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'; mso-bidi-font-size: 15.0pt">,</SPAN><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">主要理由是行政诉讼是从民事诉讼发展而来的诉讼形式,很多行政争议产生于民事争议或与民事争议有密切的关系(本案就是如此,劳动争议引发),有时解决行政争议就成为解决民事争议的前提条件。再者,人民法院在行政诉讼中有时仍然要参照适用民事诉讼的程序及制度,采用民事诉讼规则进行,《最高人民法院关于执行〈中华人民共和国行政诉讼法若干问题的解释〉第九十七条明确规定:人民法院审理行政案件除依照行政诉讼法和本解释外,可以参照民事诉讼法的有关规定。</SPAN><SPAN style="COLOR: black"> </SPAN><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">所以本案中被告重新受理原告的申请,做了</SPAN><SPAN lang=EN-US style="COLOR: black">“</SPAN><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">五人退休问题</SPAN><SPAN lang=EN-US style="COLOR: black">”</SPAN><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">的专题研究会议,并书面答复了原告,可以适用民事诉讼的时效中断理论。</SPAN></FONT><SPAN lang=EN-US style="COLOR: black"><BR></SPAN><FONT size=3><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">  </SPAN><SPAN lang=EN-US style="COLOR: black">2</SPAN><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">、行政诉讼时效的起算一般是从行政相对人知道具体行政行为之日起计算,何为</SPAN><SPAN lang=EN-US style="COLOR: black">“</SPAN><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">知道</SPAN><SPAN lang=EN-US style="COLOR: black">”</SPAN><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">?法律未作相应解释,代理人认为,所谓</SPAN><SPAN lang=EN-US style="COLOR: black">“</SPAN><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">知道</SPAN><SPAN lang=EN-US style="COLOR: black">”</SPAN><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">应是指行政机关在作出具体行政行为时,以书面形式告知相对人行为内容(这里的内容应包括具体行政行为所依据的规范性文件)及诉权和起诉期限,而非道听途说,也不仅仅是行政机关简单的决定、批准、审批、处罚内容,这里的行政机关的内容应当包括所依据的规范性文件的内容,这样行政相对人才能真正知道行政机关的行为是否合法,否则就不能视为相对人知道行政行为内容,如果依照法律规定具体行政行为可以以口头形式告知,亦必须制作笔录,行政相对人通过非上述途径而得知具体行政行为内容的,不能视为</SPAN><SPAN lang=EN-US style="COLOR: black">“</SPAN><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">知道</SPAN><SPAN lang=EN-US style="COLOR: black">”</SPAN><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">。所以这种情况也就是最高人民法院关于行政诉讼的解释:</SPAN><SPAN lang=EN-US style="COLOR: black">“</SPAN><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">不属于起诉人自身的原因</SPAN><SPAN lang=EN-US style="COLOR: black">”</SPAN><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">,</SPAN><SPAN lang=EN-US style="COLOR: black">“</SPAN><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'; mso-bidi-font-size: 16.0pt">被耽误的时间不计算在起诉期间内。”</SPAN><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">可以把起诉期限延长至</SPAN><SPAN lang=EN-US style="COLOR: black">5</SPAN><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">年的规定,这是解释保护行政相对人诉权保护的一个具体体现。</SPAN><SPAN lang=EN-US style="FONT-SIZE: 12pt; COLOR: black"><?xml:namespace prefix = o ns = "urn:schemas-microsoft-com:office:office" /><o:p></o:p></SPAN></FONT>

<FONT size=3><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">当然,对上述理论在法学界还存在不同观点。上述理论供合议庭在合议本案时参照适用。</SPAN><SPAN lang=EN-US style="FONT-SIZE: 12pt; COLOR: black"><?xml:namespace prefix = o ns = "urn:schemas-microsoft-com:office:office" /><o:p></o:p></SPAN></FONT>

<FONT size=3><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">二、四个原告在内退前是干部职务。</SPAN><SPAN lang=EN-US style="FONT-SIZE: 12pt; COLOR: black"><?xml:namespace prefix = o ns = "urn:schemas-microsoft-com:office:office" /><o:p></o:p></SPAN></FONT>

<FONT size=3><SPAN lang=EN-US style="COLOR: black">1</SPAN><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">、从四个原告提交的工作证、职称证、聘书、培训证等证据看,四个原告在内退前是干部职务。</SPAN><SPAN lang=EN-US style="FONT-SIZE: 12pt; COLOR: black"><?xml:namespace prefix = o ns = "urn:schemas-microsoft-com:office:office" /><o:p></o:p></SPAN></FONT>

<FONT size=3><SPAN lang=EN-US style="COLOR: black">2</SPAN><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">、被告提交的部分证据也证明了四个原告在内退前是干部职务。林更屏和单位的签定的《劳动合同书》《退休审批表》《干部任职呈报表》证明了林更屏在内退前是干部职务;从被告提交的关于刘国英的《退休审批表》《干部任免呈报表》看,刘国英在内退前是干部职务(注:单位在《退休审批表》上注明刘国英在内退期间为工人是错误的);吴兴惠和单位签定的《劳动合同书》《退休审批表》《选拔干部审批表》证明了吴兴惠在内退前是干部职务;关于被告提交的刘忠秀的《劳动合同鉴证登记册》《退休审批表》证明了刘忠秀在内退前是干部职务。</SPAN><SPAN lang=EN-US style="FONT-SIZE: 12pt; COLOR: black"><?xml:namespace prefix = o ns = "urn:schemas-microsoft-com:office:office" /><o:p></o:p></SPAN></FONT>

<FONT size=3><SPAN lang=EN-US style="COLOR: black">3</SPAN><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">、被告在答辩状中也认可四个原告在内退前是干部职务。</SPAN><SPAN lang=EN-US style="FONT-SIZE: 12pt; COLOR: black"><?xml:namespace prefix = o ns = "urn:schemas-microsoft-com:office:office" /><o:p></o:p></SPAN></FONT>

<FONT size=3><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">三、被告在办理内退手续后,在内退期间虽然没有具体负责相关干部职务,但是其仍然具有干部身份(即内退干部),仍然享有干部退休条件,其退休应当按照干部退休的条件办理。(这是本案中原被告争议的焦点)</SPAN><SPAN lang=EN-US style="FONT-SIZE: 12pt; COLOR: black"><?xml:namespace prefix = o ns = "urn:schemas-microsoft-com:office:office" /><o:p></o:p></SPAN></FONT>

<FONT size=3><SPAN lang=EN-US style="COLOR: black">1</SPAN><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">、被告认为女干部内退后,在内退期间就视为工人,其退休条件也应当按照工人对待,被告的这种说法完全是凭自己的主观臆断,没有任何法律依据。到目前止被告没有提交任何法律、法规、规章或者其他规范性文件来证明女干部内退后,在内退期间就视为工人。被告认为内退后原告没有从事具体干部职务,干部职务不再存在,所以就是工人,这种说法完全是想当然。请问被告,原告在内退期间是工人,那么原告是什么工种?具体从事什么工作?原告在内退期间没有从事任何具体工作,工人身份从何而来?所以被告的说法太过于牵强附会,无法令人信服。</SPAN><SPAN lang=EN-US style="FONT-SIZE: 12pt; COLOR: black"><?xml:namespace prefix = o ns = "urn:schemas-microsoft-com:office:office" /><o:p></o:p></SPAN></FONT>

<FONT size=3><SPAN lang=EN-US style="COLOR: black">2</SPAN><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">、原告内退前是干部,内退后其办理正式退休的条件应当适用干部退休条件。渝劳发【</SPAN><SPAN lang=EN-US style="COLOR: black">1999</SPAN><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">】</SPAN><SPAN lang=EN-US style="COLOR: black">88</SPAN><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">号文件第二条规定</SPAN><SPAN lang=EN-US style="COLOR: black">“</SPAN><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">《通知》中</SPAN><SPAN lang=EN-US style="COLOR: black">“</SPAN><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">可办理退休</SPAN><SPAN lang=EN-US style="COLOR: black">”</SPAN><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">指女干部离开干部岗位两年以上(含、、、内部退养、、、、)缴费年限</SPAN><SPAN lang=EN-US style="COLOR: black">15</SPAN><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">年,年满</SPAN><SPAN lang=EN-US style="COLOR: black">50</SPAN><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">周岁及其以上,经本人书面申请后,可以办理退休</SPAN><SPAN lang=EN-US style="COLOR: black">”</SPAN><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">。此规定就是说,内退前是女干部的,如果提前退休就要符合本条规定,这就是说内退前是女干部的,要按照女干部的法定退休条件办理,如果提前按照工人的</SPAN><SPAN lang=EN-US style="COLOR: black">50</SPAN><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">岁年龄退休,则必须符合几个必要要件。</SPAN><SPAN lang=EN-US style="FONT-SIZE: 12pt; COLOR: black"><?xml:namespace prefix = o ns = "urn:schemas-microsoft-com:office:office" /><o:p></o:p></SPAN></FONT>

<FONT size=3><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">四、被告审批办理退休的具体行政行为是违法的具体行政行为。此行政行为不仅侵犯了四原告正常退休的权利,也侵犯了四原告应当享有的正常退休的待遇。</SPAN><SPAN lang=EN-US style="FONT-SIZE: 12pt; COLOR: black"><?xml:namespace prefix = o ns = "urn:schemas-microsoft-com:office:office" /><o:p></o:p></SPAN></FONT>

<FONT size=3><SPAN lang=EN-US style="COLOR: black">1</SPAN><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">、被告的具体行政行为违反了《国务院办公厅关于进一步做好国有企业下岗职工基本生活保障和企业离退休人员养老金发放工作有关问题的通知》国办发【</SPAN><SPAN lang=EN-US style="COLOR: black">1999</SPAN><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">】</SPAN><SPAN lang=EN-US style="COLOR: black">10</SPAN><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">号行政法规,第四条</SPAN><SPAN lang=EN-US style="COLOR: black">“</SPAN><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">坚决制止和纠正违反国家规定提前退休的行为。</SPAN><SPAN lang=EN-US style="COLOR: black">”</SPAN><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">第一款规定</SPAN><SPAN lang=EN-US style="COLOR: black">“1999</SPAN><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">年底仍未达到国家规定退休年龄等条件的,已办理的退休手续无效、、、</SPAN><SPAN lang=EN-US style="COLOR: black">”</SPAN><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">第二款规定</SPAN><SPAN lang=EN-US style="COLOR: black">“</SPAN><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">加强企业职工退休审批工作的管理。男职工年满</SPAN><SPAN lang=EN-US style="COLOR: black">60</SPAN><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">岁,女干部年满</SPAN><SPAN lang=EN-US style="COLOR: black">55</SPAN><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">岁、女工人年满</SPAN><SPAN lang=EN-US style="COLOR: black">50</SPAN><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">岁退休的,仍由县级人民政府劳动保障部门审批、、、按照国家有关规定提前退休的,改由省级人民政府劳动保障部门审批。、、、、、今后,凡是违反国家规定办理提前退休的企业,要追究有关领导人和当事人的责任,已办理提前退休的职工要清退回原企业。</SPAN><SPAN lang=EN-US style="COLOR: black">”</SPAN><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">本案中四原告的法定退休年龄是</SPAN><SPAN lang=EN-US style="COLOR: black">55</SPAN><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">岁,</SPAN><SPAN lang=EN-US style="COLOR: black">1999</SPAN><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">年底仍未达到法定退休年龄,直到今天仍未达到国家规定的退休年龄,所以被告已办理的退休手续无效。再者,被告审批办理的退休属于提前退休的范围,所以被告作为直辖市的区级管理部门无权审批办理退休,应当由重庆市劳动保障部门审批,所以被告审批办理退休的行政行是超越职权的违法行政行为。</SPAN><SPAN lang=EN-US style="FONT-SIZE: 12pt; COLOR: black"><?xml:namespace prefix = o ns = "urn:schemas-microsoft-com:office:office" /><o:p></o:p></SPAN></FONT>

<FONT size=3><SPAN lang=EN-US style="COLOR: black">2</SPAN><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">、被告作出具体行政行为的第一个法律依据是国务院第</SPAN><SPAN lang=EN-US style="COLOR: black">111</SPAN><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">号关于《国有企业富余职工安置规定》第</SPAN><SPAN lang=EN-US style="COLOR: black">9</SPAN><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">条规定,此规定第一层意思是企业职工距法定退休年龄不到</SPAN><SPAN lang=EN-US style="COLOR: black">5</SPAN><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">年的,经本人申请可以办理内退。但这种规定和本案有什么关系呢?本案中争议的焦点是被告审批办理正式退休时具体行政行为是否合法,而内退是企业与职工之间的劳动关系,也不属于行政审批范围,况且依据本条规定,四人法定退休年龄是</SPAN><SPAN lang=EN-US style="COLOR: black">55</SPAN><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">岁,单位在办理内退时,四人距法定退休年龄均大于</SPAN><SPAN lang=EN-US style="COLOR: black">5</SPAN><SPAN style="COLOR: black; FONT-FAMILY: 宋体; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">年,所以单位在办理内退时也违反了国务院的行政法规。此规定第二层意思是,在内退期间达到国家法定退休年龄时,可以办理正式退休手续,但是被告如果引用适用本条第二层规定,那么被告必须首先证明原告在内退期间由干部转变为工人,并拿出干部在内退期间就是工人,其退休条件适用工人规定的法律依据,否则被告就是先把错误的前提假定为正确的前提,然后推出所谓正确的结论。</SPAN><SPAN lang=EN-US style="FONT-SIZE: 12pt; COLOR: black"><?xml:namespace prefix = o ns = "urn:schemas-microsoft-com:office:office" /><o:p></o:p></SPAN></FONT>

mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'">号文件是印刷错误或者打印错误。所以综上所述,被告提交的</SPAN><SPAN lang=EN-US style="COLOR: black">57</SPAN><SPAN style="COLOR: black; FONT-FAMILY: 宋体;
